President Muhammadu Buhari has written to the National Assembly to inform it of his intention to proceed on a 10-day working leave.
Bar and Bench watch learnt on Thursday that the letter was addressed to both the president of the Senate and the Speaker of the House of representatives.
A copy of the letter addressed to the President of the Senate, Senator Bukola Saraki, Buhari and read out to lawmakers on Thursday said the Vice President, Yemi Osinbajo, will be Acting President during the period.
Buhari activated section 145 of the 1999 Constitution (as amended) to transfer the authority to rule to Prof Osinbajo.
Section 145 of the 1999 Constitution reads: “ whenever the President transmits to the President of the Senate and the Speaker of House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits a written declaration to the contrary, such function shall be discharged by the vice president as acting president.”
Buhari did not give any reason for embarking on the leave but he stated that the leave would commence on January 23.
Although Buhari would need to write another letter to formally inform the National assembly that he was done with his leave, he has however given February 6, 2017 as his resumption date.
Buhari, it would be recalled embarked on leave last year February, less than one year ago.
